1. Who we are

This website is owned and operated by EMpowered with Emily Mallender Ltd, a company registered in England and Wales under company number 16790150, referred to in this policy as "we", "us" and "our".

We are the data controller for the personal information described in this policy, which means we decide how and why it is used.

2. What this policy covers

This policy explains what personal information we collect when you use our website, why we collect it, who we share it with, how long we keep it, and what rights you have over it.

It covers visiting our website, adding a listing to the EMpowered Directory, signing up to our emails, buying from us, and getting in touch with us.

3. What we collect and why

Using the website

When you visit our website we collect information about how it is used, including your IP address, rough geographical location, browser and device, where you came from, which pages you looked at and how long you stayed. This comes from Google Analytics.

We use this to understand how the website is performing and to improve it. The legal basis is our legitimate interests, namely running and improving our website.

Your account

If you create an account, or one is created for you when you add a directory listing, we hold your name and email address. We use this to operate your account, keep it secure, and contact you about it.

The legal basis is the performance of our contract with you, namely providing the account you asked for.

The EMpowered Directory

If you add a listing to the EMpowered Directory, we process the details you provide in order to publish and maintain that listing.

The following are published publicly and can be seen by anyone: your business name, your name, your category, your short bio, and your photo or logo. If you are an EMpire member, we also publish your tagline, introduction, services, location, contact email address, phone number, website address, social media links, photo gallery, and any reviews and ratings left for you by other members.

The email address you use to create your account is not published on your listing. It is used to set up and manage your account and to contact you about your listing.

Every listing is reviewed by us before it appears, and changes to a live listing are reviewed before they take effect.

If you leave a review on another member's listing, your name and your review are published on that listing.

The legal basis for this processing is the performance of a contract between you and us, or taking steps at your request to enter into such a contract, namely providing and maintaining the directory listing you have asked us to publish.

Marketing emails

We will only send you marketing emails where you have given us your consent. Consent is given by ticking the marketing box when you submit or edit your directory listing, or by signing up to our emails elsewhere on our website.

The box is never ticked for you, and you do not have to tick it to get a directory listing.

The legal basis is your consent. You can withdraw it at any time, by using the unsubscribe link in any marketing email, by unticking the box on your directory listing, or by contacting us. Withdrawing your consent will not affect your directory listing in any way.

We keep a record of when you gave or withdrew consent, and of the wording you agreed to at the time, so that we can demonstrate we have your permission.

Buying from us

We do not take payments on this website. If you buy a product or service from us elsewhere, for example through our membership or booking platforms, we process your contact details and the details of the transaction in order to supply what you have bought and to keep proper records. Those platforms handle payment directly, and we do not store your card details.

The legal basis is the performance of our contract with you, and our legal obligation to keep accurate financial records.

Getting in touch

If you contact us, by email, through a form on our website, or on social media, we process the content of your message and any contact details you give us, so that we can reply and keep a record of the conversation.

The legal basis is our legitimate interests, namely responding to enquiries and keeping proper records.

Legal claims and insurance

We may process any of the information described in this policy where it is necessary to establish, exercise or defend legal claims, to obtain or maintain insurance, or to take professional advice. The legal basis is our legitimate interests in protecting our business and our legal rights.

4. Who we share your information with

We do not sell your personal information. We share it with the following service providers, who process it on our behalf and only on our instructions:

  • HighLevel, our customer relationship and email marketing platform. When you submit a directory listing, your name, email address, phone number, business name, category, website and short bio are sent to HighLevel, together with a record of whether you have consented to marketing.
  • Our website hosting provider, who hosts our website and stores its database.
  • Google Analytics, which we use to understand how our website is used.

We may also share your information with our insurers or professional advisers where necessary, or where we are required to do so by law.

5. Transfers outside the UK

Some of our service providers are based outside the United Kingdom, which means your personal information is transferred and stored outside the UK. This includes HighLevel, which is based in the United States.

Where we transfer personal information outside the UK, we do so under a written agreement with the provider that includes the standard contractual clauses approved for international transfers, together with the UK Addendum to those clauses. These are designed to give your information the same protection it has in the UK.

6. How long we keep it

  • Directory listings and the account attached to them: for as long as your listing is published. If you ask us to remove your listing, we will delete it and the account within 30 days.
  • Marketing consent: for as long as you remain subscribed. If you withdraw consent, we keep a record of the withdrawal and of the original consent for 2 years, so that we can show we acted on your request and so that we do not contact you again by mistake.
  • Enquiries and correspondence: 2 years after our last contact with you.
  • Payment and transaction records: six years, in line with our legal obligations.

We will not keep your personal information for longer than we need it, unless we are required to keep it by law.

7. Your rights

Under data protection law you have the following rights:

  • To be told how we use your personal information, which is what this policy is for.
  • To ask for a copy of the personal information we hold about you.
  • To ask us to correct anything that is wrong.
  • To ask us to delete your personal information.
  • To ask us to restrict how we use it.
  • To ask us to transfer it to another organisation.
  • To object to us using it.
  • To withdraw your consent at any time, where we are relying on your consent.

You will not be charged for exercising any of these rights. We may ask you for information to confirm who you are before we act on a request. We will respond within one month.

To make a request, contact us using the details in Section 1.

If you are unhappy with how we have handled your personal information, you can complain to the Information Commissioner's Office at ico.org.uk or by calling 0303 123 1113. We would appreciate the chance to put things right first, so please do come to us before you do.

8. Cookies

A cookie is a small file containing an identifier that a website sends to your browser and your browser stores. Some cookies last only until you close your browser, and others stay until they expire or you delete them.

We use cookies to:

  • recognise you when you visit and as you move around the website;
  • tell whether you are logged in;
